• Failure by MEMBER to comply with these Terms may result in immediate suspension, restriction, or permanent termination of access to the platform without prior notice. Chemical Market shall not be liable to MEMBER or any third party for such actions.
• Chemical Market is an independent B2B marketplace platform and is not a buyer, seller, manufacturer, stockist, trader, distributor, or owner of goods listed on the platform. Any transaction resulting from information available on Chemical Market is solely between the buyer and seller.
• Chemical Market does not guarantee the accuracy, authenticity, legality, completeness, certifications, availability, or reliability of information posted by MEMBERS. While reasonable efforts are made to verify listings and member information, Chemical Market cannot guarantee the same.
• Chemical Market is not responsible for the quality, condition, legality, safety, purity, packaging, storage, transportation, delivery, or resaleability of any product listed or sold by MEMBERS.
• MEMBER agrees to post only lawful products and accurate information. Any misleading, fraudulent, deceptive, unauthorized, counterfeit, or illegal listings are strictly prohibited.
• MEMBER agrees to post products that are new and in saleable condition unless clearly stated otherwise within the product description.
• Chemical Market does not guarantee uninterrupted or error-free availability of its website, mobile applications, APIs, servers, or related services.
• Chemical Market reserves the right to restrict, suspend, remove, edit, reject, or deny access to any listing, enquiry, product, service, or MEMBER account at its sole discretion.
• Membership plans, rights, features, pricing, subscription fees, advertising fees, and platform policies may change at any time without prior notice.
• MEMBER shall not access, scrape, crawl, harvest, copy, download, or extract data from Chemical Market using bots, scripts, automated software, AI systems, crawlers, or any automated means unless expressly authorized in writing.
• MEMBER agrees not to use Chemical Market for spam, phishing, data harvesting, misleading enquiries, fake enquiries, unlawful marketing, or activities that may damage the reputation of Chemical Market or its MEMBERS.
• MEMBER shall use information available on Chemical Market solely for legitimate business communication, product sourcing, product sales, and related industrial enquiries.

• MEMBER is solely responsible for all activity conducted through their account, including listings, enquiries, messages, uploads, and transactions.
• MEMBER agrees to comply with all applicable local, national, and international laws, regulations, import/export controls, chemical handling requirements, pharmaceutical regulations, environmental laws, and trade compliance obligations.
   
• Prohibited Products, Controlled Substances & Illegal Activities:
  MEMBER strictly agrees not to post, advertise, list, promote, enquire for, distribute, buy, sell, or engage in transactions involving:
  • Illegal chemicals or banned substances
  • Narcotic drugs or psychotropic substances
  • Controlled pharmaceutical products without authorization
  • Drug precursors or chemicals intended for substance abuse
  • Counterfeit pharmaceutical products
  • Hazardous materials prohibited under applicable laws
  • Explosives, illegal toxins, or unlawful chemical agents
  • Any material prohibited under Indian law or international regulations
  Chemical Market and DCM Media Private Limited maintain a strict zero-tolerance policy toward illegal substances, prohibited pharmaceuticals, drug abuse chemicals, or unlawful activities. Chemical Market performs reasonable moderation, verification, compliance reviews, and monitoring to prevent such listings and activities.   MEMBER is solely responsible for all content uploaded or published on Chemical Market, including but not limited to product listings, specifications, images, certificates, brochures, documents, messages, reviews, and enquiries. By posting content, MEMBER confirms that:
  • The content is lawful and accurate
  • The MEMBER has rights to publish the content
  • The content does not infringe intellectual property rights
  • The content does not violate any laws or regulations
  Chemical Market reserves the right to remove, modify, restrict, or reject any content without prior notice.
   
• Disclaimer of Warranties:
  Chemical Market and DCM Media Private Limited provide the platform and services on an “as is” and “as available” basis without warranties of any kind, whether express or implied. Chemical Market does not guarantee:

  • Product quality or product authenticity

  MEMBER uses the platform entirely at their own risk.
   
• Indemnification:
  MEMBER agrees to indemnify, defend, and hold harmless Chemical Market, DCM Media Private Limited, its directors, employees, affiliates, contractors, partners, licensors, and service providers from any claims, liabilities, damages, losses, penalties, legal proceedings, or expenses arising from:
  • Violation of these Terms
  • Illegal or prohibited activities

• Limited Liability:
  To the maximum extent permitted by law, Chemical Market and DCM Media Private Limited shall not be liable for any direct, indirect, incidental, consequential, special, punitive, business, commercial, or financial damages arising from use of the platform or transactions between MEMBERS. Total liability, if any, shall not exceed the total fees paid by MEMBER to Chemical Market during the preceding 12 months.
   
• Third Party Services & Payment Gateways:
  Payment processing services may be provided through third-party payment providers including Razorpay, Paytm, Stripe, banks, or other authorized providers. Chemical Market does not store complete credit card or banking information on its servers. MEMBER acknowledges that payment processing is subject to the terms and policies of the respective payment providers.
   
• Termination:
  Either party may terminate membership or services by providing written notice as applicable under the agreed subscription or service plan. Chemical Market reserves the right to immediately suspend or terminate services without refund in cases involving policy violations, fraud, abuse, illegal activity, or misuse of the platform.
   
• Governing Law & Jurisdiction:
  These Terms and the use of Chemical Market services shall be governed by and interpreted in accordance with the laws of India.
